As the Administrator of Nova Scotia’s Extended Producer Responsibility (EPR) for Packaging, Paper Products and Packaging-Like Products (PPP) Regulations, Divert NS is responsible for overseeing compliance and enforcing the obligations of producers, processors, and producer responsibility organizations.
The Regulations authorize the Administrator to recover its costs for oversight. As Divert NS must consult with affected parties when establishing methods for cost recovery, producers are engaged annually to provide feedback on proposed fees.
2026 EPR Oversight Fee Consultation
Divert NS kicked off their 2026 EPR Oversight Fee Consultation with a webinar on April 1, 2026. The webinar provided background information on key milestones, Divert NS’ fee setting principles and the 2026 proposed fee rates. A recording of the webinar is available here.
A copy of the presentation, webinar recording, and other key resources that guide Divert NS’ fee setting process are posted and located on the right sidebar. The Fee Estimator has been updated with the 2026 proposed rates to allow producers to estimate their fees.

2025 EPR Oversight Fees
Divert NS’ EPR Oversight Fee Consultation for 2025 has concluded and the fee rates have been finalized. Divert NS will proceed with the two-tier fee structure as outlined in the table below:

Fee Consultation Summary Report
Divert NS has published a Fee Consultation Summary Report that summarizes the consultation process, the feedback received and how the feedback influenced decision making for setting fees. Key themes addressed include:
- Comments on the proposed fee structure
- Comparison of Divert NS’ oversight costs with agencies in other jurisdictions
- Discussion about whether start-up costs should be included in the fees
- Timing of fee collection
- Feedback related to Divert NS’ enforcement and compliance efforts.
EPR Oversight Fee Invoices
Invoices will be available in the EPR Portal on October 1, 2025. Invoices must be paid directly to Divert NS, as Circular Materials is unable to facilitate payment of EPR Oversight invoices on behalf of producers at this time.
Invoices should be downloaded and forwarded to a producer’s accounting department for payment. Alternatively, producers are encouraged to add a contact from their accounting department in the EPR Portal.

EPR Oversight Fee Estimator
Producers can use the estimator to calculate their 2026 EPR Oversight Fees.
