Who is considered a producer?

A person/entity who supplies designated material comprised of paper, rigid plastic, flexible plastic, glass, metal, or a combination of these materials to consumers and are considered one of the following:

Brand Holder – of the designated material if the brand holder is a resident of Canada.

Importer – if there is no person who meets the description of brand holder, of the designated materials then the importer is considered the brand holder if they are a resident of Nova Scotia

Retailer – if no person meets the definition of brand holder or importer the retailer is considered the producer.

Franchisor – if the business is operated wholly or in part as a franchise, the franchisor is the obligated producer, if that franchisor has one or more franchises located in Nova Scotia

Resident of Canada – having a physical presence in Canada, even if the manifestation is a home office run by an agent.
